II. Terms of use

The following Terms of Use define the terms and conditions whereby CIRAD makes the www.ou-publier.cirad.fr website (hereinafter referred to as the “Website”) and associated services available to Users (hereinafter referred to as “Users”) and how Users access the site and use the services.

Any visit to the Site is subject to these Terms of Use.

Therefore, Users accept that by visiting the Website they expressly accept all the following terms and conditions.
The current on-line version of the Terms of Use (version 1) is the sole enforceable version for the duration of Website use until replaced by a new version. CIRAD reserves the right to change these Terms of Use at any time and without warning, to adapt them to the development of the Website and its use.

Website access

Users of the Website acknowledge having made sure that their device is exempt from any viruses and is in perfect operating condition.

Users are reminded that the confidentiality of correspondence cannot be guaranteed on the Internet and that each User is responsible for taking all appropriate measures to protect their own data, hardware and/or software from contamination by any viruses that may be circulating on the Internet.

Website management

CIRAD does its utmost to ensure access to the Website 24/7, except in the event of force majeure or an event beyond its control and subject to any breakdowns and maintenance operations required for the smooth operation of the Website and its services.

Consequently, CIRAD cannot guarantee the availability of the Website or its services or transmission reliability and performance in terms of response time or quality. No technical assistance is provided to Users by telephone or electronic means.

Moreover, for effective site management, CIRAD may need to interrupt access to the Website or to some of its services or limit access to all or part of the Website at any time without warning, without giving grounds for compensation. CIRAD may also remove, at any time, any information likely to disrupt the operation of the Website or contravene national or international laws.

The information and documents available on the Website or accessible via the Website, come from sources deemed to be reliable.

However, they may contain technical inaccuracies and typographical mistakes.

CIRAD reserves the right to correct them once informed of such errors.

Users are therefore encouraged to check the accuracy and relevance of the information and documents available on the Website.

The information and documents available on the Website may be changed or updated, at any time. Notably, they may have been updated between their being downloaded and their being read by the User.

Intellectual property

The www.ou-publier.cirad.fr Website is the exclusive property of CIRAD.

The general structure of the site and its content are the exclusive property of CIRAD and are legally protected under intellectual property law (copyright, databases, software, trademarks, etc.).

All photos and illustrations appearing on the Website belong to CIRAD or are used with the agreement of their owners for use on the CIRAD website only.

Any reproduction, representation or adaptation of all or part of the Website by any individual or legal entity, by any means whatsoever, without prior written permission from CIRAD is forbidden and would constitute an act of infringement punishable under articles L. 335-2 et seq. of the French Intellectual Property Code.

All the documentary resources, texts, books and illustrations placed on-line by CIRAD are protected by copyright and by the database protection law covering the databases owned by CIRAD under articles L. 341-1 et seq. of the French Intellectual Property Code.

Any total or partial reuse or extraction of the Website’s databases by an individual or legal entity, by any means whatsoever, is forbidden and would constitute an act of infringement punishable by articles L. 343-1 et seq. of the French Intellectual Property Code.

Any total or partial reproduction of the CIRAD trademarks or logos without its prior written permission is forbidden under articles L. 713-2 et seq. of the French Intellectual Property Code.

The fact that CIRAD may not launch proceedings immediately on learning of such unauthorized uses shall not be deemed to be acceptance of the said uses or the waiver of legal action.

Responsibilities

CIRAD shall not be held responsible for any damage, be it direct or indirect, that might occur from accessing, using or downloading content via the Website, notably any damage or virus that might infect the User’s device or any other hardware.

CIRAD shall not be held responsible for any failure, breakdown, difficulty or interruption in Website operation preventing access to the Website and/or use of services by the User or any third party.

Use of the information and documents available on the Website is the sole responsibility of the User, who accepts any resulting consequences, without seeking to hold CIRAD responsible.

CIRAD shall not be held responsible for damage of any kind resulting from the interpretation or use of information and documents available on the Website.

Hypertext links

The Website may contain hypertext links redirecting to other sites available on the Internet. By following such links to other resources, the User leaves the CIRAD website. Any information available via such links on other websites is beyond the control of CIRAD, which declines any responsibility for such content.

It is possible to create a link redirecting to the Homepage of this Website without CIRAD’s express permission, provided the link opens the Website in a new browser window or tab.

However, CIRAD requests to be informed beforehand and may, at any time, require the link to be deleted without needing to justify its decision.

Personal data protection

In compliance with French Data Protection Legislation (Loi “Informatique et libertés” No. 78-17 dated 6 January 1978 in its modified version) and the General Data Protection Regulation (GDPR) No. 2016/679/UE dated 27 April 2016, CIRAD, as data controller, guarantees the privacy of Website Users.

Governing law and relevant courts

These Terms of Use and the Website content are regulated by French law.

The parties agree that any conflicts occurring in relation to these Terms that fail to find an amicable agreement within a reasonable time span shall be brought before the relevant French courts.

III. Personal data

CIRAD is keen to respect your personal data and privacy. When using this Website, personal data are treated as follows.

Processing procedures

The User, a private individual, is informed that the information collected via the Website is intended for authorized CIRAD services and any subcontractors, in compliance with the purposes set out.

When consulting the Website or accessing CIRAD’s on-line services, Users may be asked to voluntarily provide certain personal data (surname, forename, etc.) . Other data may be collected directly via the User’s device.

Reviewing Activities declaration form

The information gathered by means of this form by CIRAD, as data controller, is processed for the legitimate purpose of enriching its journal and publisher records and promoting its research activities. The purpose of such processing is to display consolidated records on the Website.

The data entered are intended for the CIRAD Scientific Information Service and will only be accessed by CIRAD staff authentified on the Website in the records. They will also be communicated in aggregated form in the yearly activities reports of staff members and teams, which are accessible to the said staff members, Research Unit managers and CODIR members in anonymous form.

Data processed in this way are stored and displayed on the Où Publier Website in the yearly activities reports of staff members for a period of 5 years plus the current year.

In all cases, personal data collected and processed on the Website are protected by appropriate technical and organizational measures, to ensure a level of security appropriate to the risk.
